This document refers to the protection of natural persons with regard to the processing of personal data and the free movement of such data and is fully regulated by Portuguese law.

Agata Castro, through ACTC, Agata Castro Transformational Coaching & ACTA, Agata Castro Transformational Academy, assumes the permanent commitment to protect the privacy of personal data provided by its clients in the context of the services provided.

This document aims to provide users with the necessary information regarding Agata Castro’s privacy policy, so that they can give their express, free and informed consent to the processing of their personal data carried out by Agata Castro when requested during the process of subscription to the services.

The customer declares to know and accept the rules of the privacy code available on the Agata Castro website, consenting the publication & disclosure of their personal data.

The personal data provided by users during the process of subscription to the services by Agata Castro will be processed in accordance with the terms legally and regulatorialy provided. 

The processing of personal data shall mean the entire operation or set of operations carried out with or without the help of electronic or automated means, in relation to the collection, recording, organisation, maintenance, interrogation, preparation, modification, selection, extraction, comparison, use, interconnection, blocking, communication, disclosure, deletion and destruction of data, whether the latter are contained in a database or not.

The processing of personal data may consist of text files, photographic or video images, audio tracks, telephone lines and any other information that may be used to identify the person concerned, according to the type of services requested. 

This procedure will respect the principles of legality, good faith and transparency and ensure respect for users’ rights, in particular their right to private life.

Processing objectives

The purpose of this procedure is to allow the provision of services by Agata Castro in the way desired by the client, as well as the independent management of the service by the latter. To this end, the customer must register as a user and create his profile, when providing the services by Agata Castro. Collection, storage and processing of data for subsequent operations, technical and administrative management of services and exchange of electronic communications.

The processing of the data by Agata Castro will comply with all applicable legal rules, in particular in compliance with the tax and accounting obligations that prevent it. 

Users’ personal data will also be processed in order to allow “web browsing”.

The purpose of this processing is also to collect, store and organise the customer’s personal data in order to carry out statistical analyses anonymously. This analysis will not allow the identification of the client and will only be intended to ascertain the quality of the services provided by Agata Castro.

Processing procedures

Customers’ personal data will be processed electronically and automatically.

Communication and disclosure of common personal data

Common personal data (non-sensitive) may be communicated by Agata Castro:

People and companies that provide legal, tax, financial and accounting consulting services to Agata Castro. Institutions, entities and/or authorities to whom the data must be transmitted in the terms of the case and/or legally provided for;

Entities linked to the commercial activity pursued by Agata Castro and strictly related to the provision of services by Agata Castro (e.g. National domain name registration authorities, the Authorities managing the Whois database, and entities to which Agata Castro delegates the technical maintenance of the services provided by it, including the maintenance of network devices and electronic communications networks.

Optional or mandatory consent

If the customer does not provide his/her personal data, the subscribed services may not be activated, which is a decision of Agata Castro.

Processing sensitive data

When the customer uses The Castro Agata services, certain personal data classified as sensitive may be processed, particularly data that reveals race or ethnic origin, religious, philosophical or other beliefs, political opinions, party affiliation, health status or sexual orientation.

Agata Castro suggests that the client does not publish sensitive personal data, unless it is strictly necessary or that it chooses services that do not imply such publication.

In any case and outside of exceptional situations, this data will not be published.

Based on the above, Agata Castro recalls that if the customer does not provide his express consent regarding the processing of sensitive data and wishes to use later services involving the processing of sensitive personal data he will have to modify his/her registration in advance, providing the necessary consent.

If for some reason the customer does not provide his express consent for the processing of personal data of a sensitive nature and subsequently subscribe scensure services that presittise such processing to Agata Castro cannot be held responsible, since the disclosure of sensitive data on the web will be the sole responsibility of the client, regardless of whether the management of the web space is provided by Agata Castro.

However, we reiterate the above mentioned importance of the prior modification of the registration by the client, granting the necessary authorization for the processing of sensitive data if you wish to use services that necessarily involve the use/processing of this information.

Sensitive data, particularly those that reveal the sexual orientation of the client will not be communicated (except in cases of legal imposition) or disclosed by Agata Castro.

If the client intentionally uses the services provided by Agata Castro to communicate and/or disclose his/her sensitive personal data on the Internet, such situation does not represent any conduct accepted or practised by Agata Castro to the extent that the client communicates this information in the context of the private and independent management that makes the web space made available to him by Agata Castro or in the context of the normal use of the services provided by the latter.

Possible processing of the personal data of third parties provided by the person concerned

When the customer uses certain services that allow him to request the registration of domain names in favour of third parties, the personal data of third parties provided by the customer to the operator may be processed. In this case, the client assumes the role of independent data manager and the inherent legal obligations, in particular compensation for any damages caused to the third party for breach of rules relating to the protection of personal data. In any case, if the customer provides or processes personal data of third parties while using services provided by Agata Castro, he fully guarantees and assumes that the third party has previously authorised the processing of his/her personal data.

Controller and Data Processor

The data controller is: Agata Castro, headquartered at 30 Regent Street, Great Yarmouth, Norfolk, NR30 1RR, United Kingdom.

You can contact the data processor, in accordance with the law, at any time by contacting the data controller – Agata Castro, in order to exercise the rights provided by law.

Data storage and security measures

The data will be stored for the time defined by applicable laws and regulations, on the servers used by Agata Castro. In any case, your data will be stored strictly for the period of time necessary to achieve the objectives mentioned above, which must correspond to the validity of the contractual relationship between Agata Castro and the client. If you cancel your account, as soon as you stop using the Services, your data will be erased, except where the maintenance of the same is strictly necessary for the performance of legal, financial, tax and accounting obligations, after you cease your use of the service. Once these obligations are fulfilled, your data will be deleted. We also inform you that this data will be collected, processed and maintained in full compliance with the legal provisions.

Right of access to personal data and other rights

The customer has the right to be informed:

the source of personal data;

the purposes and methods of treatment;

the logic applied to the processing, in particular whether it is carried out with the help of electronic means;

identification of the data controller, data processor and its representatives;

of the entities or categories of entity to which personal data may be communicated and who may know such data as designated representative(s) in the territory of the State, data processor(s) or person(s) responsible for processing.

The customer has the right to obtain:

  1. a) updating, rectification or, when interested, the integration of the data;
  2. b) deletion, anonymity or blocking of data that has been processed illegally, including data whose maintenance is necessary for the purposes for which it was collected or consequently processed;

(c) certification for that purpose that transactions pursuant to points (a) and (b) have been notified to the entities to whom the data have been communicated or disseminated, unless this requirement proves impossible or manifestly disproportionate to the right to be protected. 

The Customer has the right to reject, in whole or in part:

(a) for legitimate reasons the processing of personal data concerning him or her, even if they are relevant to the purpose of the collection;

  1. b) the processing of personal data concerning him, carried out for the purpose of sending advertising material or direct sales, or for evaluation of market performance or commercial communication.
